ABSTRACT

In this chapter, we will consider the issue of easements and profits à prendre. Easements and profits are interests in land and are property rights that à person has over land held by someone else. Easements are much more important than profits a prendre. Such rights can be extremely important and can significantly increase the value of land as they benefit land; for instance, they may give a landowner the right of access over a neighbour’s land. By the same notion, the existence of an easement can be a burden on the neighbour’s land as it may limit the way that land can be utilised. As we will see, easements are not just confined to rights of way across a neighbour’s land but can be created to benefit land in many ways.
