5.1 Identifying the “user” of a motor vehicle is the matter at the heart of motor vehicle insurance. Under the RTA 1988 s 145(3)(a) the compulsory liability insurance must cover “the use of a vehicle.” The crucial question is whether or not at a particular time a motor vehicle is being used.
