Judge Parry 3 gives · another cause for the new measures, namely, the determination of the divorce court practitioners to preserve their lucrative practices which were threatened by the possibility of divorce business being transferred to the County Courts unless a way could be found for assisting the thousands of people who were seeking divorces but were unable to pay the cost. However this may be the Bar, and particularly the Divorce Court practitioners, were wholly obstructive when the new Rules were first issued. 4 They objected to the proposals on the grounds that they involved too heavy a burden on the Bar and also that, in providing for the payment of counsel by the poor person's opponent, if unsuccessful, they infringed the "primary rule of Bar morality " that payment of counsel should not be affected by the result of a case.
