ABSTRACT

How the law works as a contract between Persons, and how it affects Person-Nonperson relations is just part of the story of the law in society. In this chapter I will look more broadly at the relationship between the two domains of society—the civil domain (into which the law may intrude) and the communal domain (which is, at base, “lawless”—though certainly not “normless”). The goal is to show that an understanding of the relationship between the civil domain and the larger society constitutes an important link in understanding the relationship between law and society.
