Fifth, at present the funds of a trade union as such are immune from all such actions for damages. In the case of industrial action in opposition to an award this immunity could be removed if the strike had the official support of the trade union . This would mean effectively that the strikers in such circumstances could not expect any strike pay from their union, since this would mean that the strikers had had the official support of the union whose funds would then be at risk for any damages caused by the strike.
