ABSTRACT

The development of international criminal law from the 1990s to the present is arguably the most profound current aspect of international law, and perhaps one of the most important developments of international relations more broadly. According to Professor Ken Anderson, the development of international criminal law is the signal achievement in international law after the Cold War.2 The UN Security Council (UNSC) has been at the centre of this development. The Council is both a political and legal organisation, giving rise to a fundamental tension between these two dimensions.
