ABSTRACT

There is no shortage of claims regarding the anticipated benefits of international criminal trials. Transitional justice enthusiasts argue that, in addition to punishing the guilty, trials for war crimes and crimes against humanity can produce a range of other effects. They will provide accountability, give voice to the victims and create a historical record. In addition, it has increasingly been argued in recent years, they will serve as a powerful deterrent mechanism, which will diminish the occurrence of future war crimes and crimes against humanity.
