ABSTRACT

The Negotiating Group on MTN Agreements and Arrangements which is in charge of antidumping matters during the Uruguay Round has now received substantial propositions - from the Korean, US and EC delegations among others - for improving the Antidumping Code inherited from the Tokyo Round. All the propositions follow a codification approach similar to the Tokyo Round approach and present more systematized interpretations of the existing notions embodied in the GATT Article devoted to antidumping (Article VI): export price, normal and constructed values, comparison of normal value and export price, threat of injury, price undercutting and undertaking, etc...
