ABSTRACT
This requires having an adequate focus both in terms of international legal analysis and of historical and political sciences. In order to obtain an outcome that could be defended against systemic and evidentiary considerations, two methodological requirements should be observed. First, it is necessary to locate the political developments over the past two decades in the broader historical context. It is necessary to understand that over many centuries international political and legal systems have been witnessing major transformations alleged to have the potential to affect the essence of the international legal system – what some today would, modishly, denote as international constitutional moments. This broad historical perspective can adequately explain how exceptional the events or processes over the past two decades have been.
